Takedown Policy and Procedures

Rent Plan, LLC dba RentPlan.com respects the intellectual property rights of others, just as it expects third parties to respect its rights. Pursuant to the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), a copyright owner or their agent may submit a takedown notice to us via our DMCA Agent listed below. As an internet service provider, we claim immunity from infringement claims under the “safe harbor” provisions of the DMCA. To submit a valid infringement claim, you must provide the following information:

Notice of Infringement – Claim

To file a DMCA takedown notice, you must provide the following information:

  • A physical or electronic signature of the copyright owner (or their authorized agent).
  • A description of the copyrighted work that is claimed to be infringed.
  • Identification of the infringing material to be removed, including the URL or other specific location of the material to allow us to locate it.
  • Contact information for the complaining party, including your name, physical address, email address, and phone number.
  • A statement of good faith belief that the use of the material is unauthorized by the copyright owner or their agent.
  • A statement under penalty of perjury that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the copyright owner.

Misrepresentation of claims under the DMCA may result in civil penalties, including costs and attorney fees, under Title 17 USC §512(f).

Counter-Notification – Restoration of Material

If you believe material was removed in error or due to misidentification, you may submit a counter-notification to our DMCA Agent. Your counter-notification must include the following:

  • Your physical or electronic signature.
  • A description of the material removed and its original location before removal.
  • A statement under penalty of perjury that you believe the material was removed due to error or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your location or, if outside the United States, to any judicial district where Rent Plan, LLC may be found.

Misuse of the counter-notification process is subject to penalties under Title 17 USC §512(f). Email your counter-notification to: dmca@rentplan.com.

Repeat Infringer Policy

Rent Plan, LLC takes copyright infringement seriously. We maintain records of DMCA notices received and make a good faith effort to identify and terminate repeat infringers.

Modifications

Rent Plan, LLC reserves the right to modify this DMCA Policy at any time. Updated policies will be posted on this page with the date of revision.
